Terms of Use

1. Overview
These Terms of Use (“Terms”) govern your access to and use of the Kynetically™ mobile application and website (together, the “Service”). By using the Service, you agree to these Terms.
2. Not Medical Advice
Kynetically is a wellness tool designed to support breathing and self-regulation. It is not medical advice, diagnosis, or treatment. If you have a medical concern, seek advice from a qualified healthcare professional. If you believe you may be experiencing an emergency, contact local emergency services immediately.
3. Eligibility
You must be legally capable of entering into a binding agreement in your jurisdiction to use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
4. Your Use of the Service
You agree to use the Service responsibly and not to misuse it. You agree not to:
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorised access to systems or data
- Reverse engineer, decompile, or attempt to extract source code where prohibited by law
- Use the Service in a way that violates applicable laws or regulations
5. Accounts & Device Access
The Service may operate without creating an account. If you choose to provide account information, you are responsible for maintaining its confidentiality and for all activity under your account.
6. Subscriptions, Trials & Purchases
Certain features may require a paid subscription (“Pro”). Purchases are processed through Apple’s In-App Purchase system. Subscription terms (price, duration, trial availability) are shown at the point of purchase.
We may use RevenueCat to manage subscriptions and entitlements. Your subscription status is determined by Apple and may be validated via RevenueCat.
You can manage or cancel subscriptions in your Apple ID settings. Cancelling stops future renewals; access may continue until the end of the current billing period.
7. Apple Standard EULA
If you download the app via Apple’s App Store, your use of the app is also subject to Apple’s Standard End User License Agreement (EULA), unless a different license is presented at the time of purchase.
8. Intellectual Property
The Service, including its design, text, graphics, and software, is owned by Asymmetree Pte. Ltd. or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless you have written permission.
9. Availability & Changes
We may update, modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, Asymmetree Pte. Ltd. is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service.
11. Indemnity
You agree to indemnify and hold harmless Asymmetree Pte. Ltd. from any claims, liabilities, damages, losses, and expenses arising out of your misuse of the Service or violation of these Terms.
12. Governing Law
These Terms are governed by the laws of Singapore. You agree to submit to the exclusive jurisdiction of the courts of Singapore, except where applicable laws require otherwise.
